We do not disclose and never not share your personal data with 3rd parties for commercial purposes and purposes not related to the delivery of Cloud Server Hosting, Dedicated Servers, VPS, Web Hosting, Colocation, and App services. Host Color LLC (HostColor, Host Color, or HC) is committed to supporting and maintaining the highest standards in the collection, use, and disclosure of any personal data as they are set out in the laws of those countries where we do business. Host Color LLC respects your privacy and takes its responsibilities regarding the security of your customer information very seriously. We are committed to providing you with a professional, valuable, and personalized Shiled Hosting service whilst safeguarding your privacy. This Privacy Policy applies to the HostColor business. It has been created to explain to you the way in which Host Color uses your personal data. This information will assist you to determine whether or not to provide us with your personal information.

This EU-U.S. Data Privacy Framework Principles compliant Privacy Policy describes the privacy principles that Host Color LLC follows with respect to personal information transferred from the European Economic Area (EEA), which includes all the European Union (EU) member states, Iceland, Liechtenstein, and Norway to the United States.

Host Color LLC complies with the EU-U.S. Data Privacy Framework Principles as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States.

Host Color has certified that it adheres to the EU-U.S. Data Privacy Framework Principles of Notice; Choice; Accountability for Onward Transfer; Security; Data Integrity and Purpose Limitation; Access; and Recourse, Enforcement, and Liability within the scope of its Privacy Shield certification. If there is any conflict between the provisions in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall prevail and conduct the policy.

HostColor’s participation in the EU-U.S. Data Privacy Framework Principles applies to all personal data that is subject to the Host Color LLC Privacy Agreement and is received from the European Union and European Economic Area. Host Color will comply with the Privacy Shield principles in respect of such personal data. Please refer to this HostColor Privacy Agreement for further information on data collection and use of personal data. Certain personal information may be subject to specific privacy policies of HostColor that are also consistent with the requirements of the EU-U.S. Data Privacy Framework Principles. Personal data is any information that allows you to be identified. The types of personal data HostColor collects may include details of your name, address, telephone number, email address, fax number, and driver’s license/photo ID.

We do not collect personal data about your racial and ethnic origin, political opinion, religious beliefs, or other beliefs of a similar nature, membership of a trade union, physical or mental health or conditions, sexual life, or any other sensitive information.

HostColor collects personal data for you through the use of enquiry and registration forms on our website, direct personal contact with you, and every time you e-mail us your details. We will use your personal data where it is necessary to do so because it is relevant to HostColor's dealings with you (i.e. it is relevant to the provision of the Shield Hosting services that you have requested from HostColor) as outlined below.

HostColor does not share any of our clients' personal data with its partners and business ecosystem. Our clients might be asked to disclose certain personal data on certain occasions for the following purposes:
a) Client’s First Name, Last Name, and Driver’s license/Photo ID, required for identification only, without being copied, transmitted, and stored by any third party, when customers require access to their equipment and for the purpose to enter into the Host Color facilities.
b) Client’s personal data such as First Name, Last Name, Company Name, Email Address, Phone Number, Business Address, and/or any other details required by any 3rd party authority for the purpose of registering a Domain Name, SSL certificate or providing any other service or digital product requested by the customer through a service order submitted to Host Color LLC.
c) Clients’ Billing details, including First Name, Last Name, Company Name, Email Address, Phone Number, Business Address, and the last 4 digits of credit cards with its online merchant account providers Chase Paymentech, PayPal, and Stripe.

HostColor may use "cookies" on our website https://www.hostcolor.com and its sub-site https://accounts.hostcolor.com. A "cookie" is information that a website puts on your hard drive so that it can remember pieces of information about you when you next visit the website or a related website. We use cookies to record personal data about you only when you use our website in order to facilitate your future activities.

Unless otherwise notified by us, HostColor will not use personal data sent in a cookie for marketing purposes. If you prefer not to receive cookies from our site, you can set your browser to warn you before accepting cookies and refuse the cookie when your browser alerts you to its presence. Host Color LLC will not use your personal data for direct marketing without your consent. This includes the provision of offers for HostColor and its third-party partners' products and services and customer surveys. While delivering its Shield Hosting services, Host Color LLC also may be required to disclose an individual’s personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.

Host Color LLC’s accountability for personal data that it receives under the EU-U.S. Data Privacy Framework Principles and subsequently transfers to a third party is described in these principles. In particular, HostColor has an obligation and liability under the EU-U.S. Data Privacy Framework Principles if third-party agents that it engages to process the personal data on its behalf do so in a manner inconsistent with these principles unless HostColor proves that it is not responsible for the event giving rise to the damage.

Host Color LLC acknowledges that the European Union individuals, who use HostColor.com or HostColorEurope.com services and digital products have the right to access the personal information that we maintain about them. Any individual who requests access, or who wants to correct, amend, or delete inaccurate data, should submit a written request to the HostColor's Privacy & Data Protection Officer, using the email address and other contact information listed below. If requested to remove data, we will respond within a reasonable timeframe.

In compliance with the EU-U.S. Data Privacy Framework Principles, Host Color LLC commits to resolving complaints about your privacy and our collection or use of your personal information. Host Color LLC is committed to cooperating with EU Data Protection Authorities (EU DPAs) and complying with the advice given by such authorities with regard to any human resources data transferred from the EU in the context of the employment relationship.

HostColor has further committed to refer unresolved privacy complaints under the EU-U.S. Data Privacy Framework Principles to EU Data Protection Authorities (EU DPAs). If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit EU Data Protection Authorities (EU DPAs) to find more information or to address the matter.

If your complaint is not satisfactorily addressed, and your inquiry or complaint involves human resource data transferred from the EU in the context of the employment relationship, you may have your complaint considered by an independent recourse mechanism: for EU/EEA Data Subjects, a panel established by the European Union data protection authorities (DPA Panel). To do so, you should contact the data protection or labor authority in your jurisdiction. Host Color LLC agrees to cooperate with the relevant national DPAs and to comply with the decisions of the DPA Panel.

Should your complaint remain fully or partially unresolved after a review by Host Color LLC, EU Data Protection Authorities (EU DPAs), you may be able to, under certain conditions, seek binding arbitration before the authorities responsible for enforcing the EU-U.S. Data Privacy Framework Principles.

HostColor is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission (FTC).
